The first step in the bankruptcy process is to determine if bankruptcy is the best way to approach your financial problems, and if so which type of bankruptcy would serve you best.

We will ask you to bring in certain records and information about your property, debts, income and expenses. Then we will prepare a bankruptcy petition and schedules required by the bankruptcy court. You will sign the documents and they will be filed with the court.

As soon as we file, an automatic stay is in effect. All creditors must contact only your bankruptcy attorney, not you. The best thing about the bankruptcy process is the immediate relief from creditors' calls and threatening letters.

The court will assign a bankruptcy trustee to oversee the case. Within a few weeks, you will meet with the trustee and the court will issue an order of discharge. The recent bankruptcy law requires you to complete a debtor education course after the bankruptcy has been filed, but before a discharge.

You must also meet with creditors in a 341 meeting to answer questions about your debts and property. Ultimately, whether you file under Chapter 7 or Chapter 13, your debts will be discharged and you will have a fresh financial start.

Among the most popular options for clients seeking bankruptcy protection to eliminate debt, Chapter 7 sells off the debtor's assets and distributes those funds to creditors in exchange for discharging the debt.
