We will ask you to bring in certain records and information about your property, debts, income and expenses. Then we will prepare a bankruptcy petition and schedules required by the bankruptcy court. You will sign the documents and they will be filed with the court.
As soon as we file, an automatic stay is in effect. All creditors must contact only your bankruptcy attorney, not you. The best thing about the bankruptcy process is the immediate relief from creditors' calls and threatening letters.
The court will assign a bankruptcy trustee to oversee the case. Within a few weeks, you will meet with the trustee and the court will issue an order of discharge. The recent bankruptcy law requires you to complete a debtor education course after the bankruptcy has been filed, but before a discharge.
You must also meet with creditors in a 341 meeting to answer questions about your debts and property. Ultimately, whether you file under Chapter 7 or Chapter 13, your debts will be discharged and you will have a fresh financial start.
Among the most popular options for clients seeking bankruptcy protection to eliminate debt, Chapter 7 sells off the debtor's assets and distributes those funds to creditors in exchange for discharging the debt. In practice, Saracco Law can help make sure that key assets such as your home or your retirement savings are insulated from the sell off allowing you to preserve a future even as you build a new financial beginning.
Our attorney works closely with you to evaluate your situation, your assets and your goals to find bankruptcy protection options that meet your needs. For many clients, Chapter 7 bankruptcy is a natural fit, eliminating or reducing debt, collections and lawsuits while giving you options to protect your home, future and family.
We take a hands-on approach to client service. From your free initial consultation through filing Chapter 7 bankruptcy, you work closely with our office and attorney. While we understand that it can be a stressful process and difficult decision to seek bankruptcy protection, we have also seen the benefits to clients throughout Central Florida who have chosen to exercise their legal rights. Because of our experience, we understand what you are going through when deciding to visit our office. We take a personal approach to each and every client. Michael Saracco meets personally with every client, talks to them one on one, and gets to understand their problems.
Whether Chapter 7 Bankruptcy is unavailable to you or you are the type of person who wants to repay all your debts, Chapter 13 Bankruptcy is available. Come in for your free consultation to discuss what is best for you and your situation.
